The RoomPlace® –12 Days of Christmas Giveaway

(the “Contest”)

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER, WIN OR CLAIM A PRIZE.  A PURCHASE WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING.

I.  NAME OF SPONSOR

TRP Acquisition, Inc. d/b/a the RoomPlace. 1000 Rohlwing Road, Suite 46; Lombard, IL 60148 (the “Sponsor”).

II.  ELIGIBILITY 

The RoomPlace® 12 Days of Christmas Giveaway (the “Contest”) is open only to legal residents of the state of Indiana, Illinois or Wisconsin who are 18 years of age or older as of the date of their entry into the Contest and who satisfy all other eligibility requirements contained in these Official Rules or applicable by law.

Employees or agents of the RoomPlace® (“Sponsor” or “Administrator”), or any of their affiliated companies, advertising agencies or promotion companies involved in the Contest (collectively, the “Contest Entities”) and each of their immediate family members or those living in the same household of Sponsor or any of the Contest Entities, as well as any of their successors or assigns, are not eligible to enter or win the Contest.

III.  HOW AND WHEN TO ENTER

There are two ways to enter - via Facebook or Instagram:

Between 12:00 p.m Central Time (“CT”) on December 13, 2021 and 11:59 p.m. CT on December 24, 2021 (“Entry Period”), eligible individuals may enter the giveaway by taking the following steps.

1)    Log into your personal Instagram or Facebook account and navigate to the @TheRoomPlace official Instagram or Facebook feed.

2)    Locate the giveaway post that invites eligible individuals to enter this giveaway, like the post, and share the post to be entered to win said product for that day. There will be a new post every day of this contest period. The post that you like, and share will be the post you are entered in to win. If you do not like and share the post, you will not be entered to win for that day.

Limit of one (1) entry per person per Day of the Entry Period as defined on the table below. Entries received in excess of the stated limitation will be void. Entries generated by script, macro or other automated means or by any means that subvert the entry process are void. All entries become the property of Sponsor.

For Social Media Platform entries, you understand that you are providing your information to Sponsor and not to Social Media Platform, and that this Contest is in no way sponsored, endorsed, administered or associated with any Social Media Platform.  Any questions, comments or complaints regarding this Contest should be directed to Sponsor, and not any Social Media Platform.  

During the entry process, you may be asked to consent to receive promotional and marketing emails or text communications from Sponsor.  Consenting to receive promotional, marketing or reminder emails is optional, does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning.  In the event you do consent to receive these emails, the use of such communications shall be subject to Sponsor’s Privacy Policy, available at https://www.theroomplace.com/info-and-policies.

By liking and sharing a post, you signify that you have read and agree to these official rules and meet the eligibility requirements. 

Sponsor can provide no technical support and accepts no responsibility for insuring the receipt or successful submission of your entry.  Mass entries or entries generated by a script, macro or use of automated methods will be disqualified.  Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software.  If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest.  No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer or any other personal electronic device related to or resulting from participation in or downloading any materials from this Contest. 

 In the event of a dispute over an electronic entry, prize will be awarded to the owner of the Social Media Platform account.  Except as otherwise contemplated by these Official Rules, and to the extent entrants may otherwise elect at the time of entry, information provided by you for this Contest is subject to Sponsor’s Privacy Policy located at https://www.theroomplace.com/info-and-policies.

IV.  HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED 

From December 14, 2021 thru December 26, 2021, excluding December 26,2021, a winner will be randomly selected each day from all eligible entries received.

The winner will be notified by the Social Media Platform on which the Contest entry was posted after the Random Drawing with instructions on how to claim their prize.  A potential Prize Winner may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) and any other requested documents within 10 calendar days from the date of attempted notification, or the prize may be forfeited in its entirety and awarded to an alternate winner, at the Sponsor’s sole and absolute discretion. Sponsor is not responsible for any undelivered Social Media Platform messages or e-mails, including e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Contest e-mail, including any winner notification e-mail, to a spam or junk folder.

People who have won any other prizes with Sponsor within 180 days of entry are not eligible to enter this Contest.  

Odds of winning depend on number of valid entries received.

Final determination of winners are always conditional on verification of eligibility and compliance with all rules and procedures.  In the event winner is deemed ineligible, fails to comply with Contest procedures, or is not available to claim prize during specified dates, then an alternate winner will be selected at random.

V.  PRIZE

Drawing AND WINNER NOTIFICATION: Potential winners will be selected in twelve (12) random drawings from December 14, 2021 thru December 26, 2021, from all eligible entries received during each Day of the Entry Period as defined on the table below. Odds of winning depend on the number of eligible entries received on that Day of the Entry Period. Potential winners will be notified by private message on Instagram or Facebook from The RoomPlace account and are required to respond within 48 hours of initial notification. Potential winners may be required to execute and return an affidavit of eligibility, tax documents, and, where lawful, a publicity and liability release. If a potential winner does not return such documents within the specified time period, claim prize by time indicated, or comply with these rules, or if a prize or prize notification is returned as undeliverable, prize may be forfeited and, at Sponsor’s discretion and time permitting, an alternate winner may be selected.

Prize: One (1) winner per Day of Entry Period (twelve (12) winners in all) will each win one (1) prize as follows:

Total ARV of all prizes: $3,613. All federal, state and local taxes, if any, and all other costs and expenses associated with prize acceptance and use are the sole responsibility of the winners. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Any of Sponsor’s merchandise awarded as a prize is exempt from Sponsor’s return policy and may not be returned or exchanged. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. For example, and without limiting the generality of the foregoing, if the prize features merchandise that is not available at the time of prize fulfillment, Sponsor may offer the winner an option to select alternate merchandise of the same value within the same category. Limit one (1) prize per person. Under ordinary circumstances, prize will be provided by Sponsor as soon as delivery allows of the potential winner’s response and return of completed documentation, as applicable; each entrant acknowledges by entering, however, that extraordinary circumstances may delay prize fulfillment longer than the stated timeframe.

VI.  RELEASES

By participating, entrants agree to be bound by these Rules and the decisions of the Sponsor, which shall be final in all respects.

By participating in this Contest and accepting any prize that they may win, entrants agree to release Sponsor, its parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns, and each Social Media Platform (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize.

Winners agree that the Released Parties have not made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize, if any, are subject to the manufacturer’s terms and therefore winners agree to look solely to such manufacturers for any such warranty and/or guarantee.

Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials, including photographs, in programming or promotional material, for any purpose (including in advertising or otherwise on social media platforms) worldwide in perpetuity, or on a winners’ list, if applicable, without further compensation or other obligations unless prohibited by law.  Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

By submitting entry materials, entrants certify that such materials are original and created by entrant, that entrants have the necessary rights, permission and authority to submit such materials, and, if applicable, that entrants maintain a valid copyright in the materials.  Entrants are prohibited from posting any unlawful, threatening, libelous, defamatory, obscene, pornographic or other material that may be considered offensive or that would otherwise violate any law.

VII.  MISCELLANEOUS; WINNERS’ LIST 

Void where prohibited.  All federal, state and local laws and regulations apply.

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Contest as originally planned.  Sponsor’s final decision, in its sole discretion, shall prevail and the decisions of the Sponsor shall be final and binding on all parties.
